Welcome to Ping Pong Virtuoso!

The terms “we,” “us” and “our” refer to Ping Pong Virtuoso. Ping Pong Virtuoso operates this store and website, including all related information, content, features, tools, products and services, in order to provide our customers with a specialized table tennis shopping experience (the “Services”).

Our online store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein (collectively, the “Terms”), describe your rights and responsibilities when you access or use our Services.

Please read these Terms carefully. They contain important information concerning your legal rights and obligations, including provisions relating to warranties, limitations of liability and dispute resolution.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms or our Privacy Policy, you should not access or use the Services.


SECTION 1 — ACCESS AND ACCOUNTS

By agreeing to these Terms, you represent that you are at least the age of majority in your province, state or country of residence, or that you have the authorization of your parent or legal guardian to use the Services where permitted by applicable law.

To access certain Services or purchase products, you may be required to provide information such as your name, email address, billing information, payment information and shipping address.

You represent that the information you provide is accurate, current and complete and that you have the right to provide such information.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity performed through your account.

You may not transfer, sell, assign or license your account to another person without our permission.


SECTION 2 — OUR PRODUCTS

We make reasonable efforts to provide accurate descriptions, specifications, photographs and representations of the products offered through our store.

However, product colours and appearance may vary depending on your display, device settings, lighting, manufacturing variations and other factors.

Specifications including weight, thickness, dimensions, hardness, colour and other characteristics may also vary within normal manufacturer tolerances.

For products such as table tennis blades, rubbers and assembled rackets, individual characteristics may vary slightly between units.

We cannot guarantee that every product will appear exactly as represented on your screen or that subjective characteristics such as speed, control, feeling, hardness or playing performance will meet an individual player's expectations.

Product descriptions, specifications, availability and pricing may be changed at any time without notice.

We reserve the right to discontinue products or limit quantities available to any person, business, geographic area or jurisdiction.


SECTION 3 — ORDERS

When you submit an order, you are making an offer to purchase the products or services listed in your order.

Ping Pong Virtuoso reserves the right to accept, decline, limit or cancel an order, subject to applicable law.

An automated order confirmation does not necessarily constitute acceptance of an order. An order is accepted once payment has been authorized and we have accepted the order for processing.

Please review your order carefully before submitting it.

Once an order has entered processing, we may be unable to accommodate cancellation or modification requests, particularly for products that have already been shipped, customized, assembled, glued, cut or otherwise modified at your request.

If we need to cancel or modify an order, we will make reasonable efforts to contact you using the email address, telephone number or other contact information provided with your order.

Returns and exchanges are governed by our Return & Exchange Policy [LINK].

Retail and Wholesale Orders

Ping Pong Virtuoso serves both retail customers and approved business or wholesale customers.

Retail prices, wholesale prices, dealer prices, promotional prices and other account-specific prices may differ.

Wholesale or B2B purchases may be subject to additional terms, including minimum order quantities, account eligibility requirements, brand restrictions, resale restrictions, payment terms, minimum advertised price policies and other manufacturer or distributor requirements.

Where separate B2B or wholesale terms have been agreed upon, those terms will apply in addition to these Terms. If there is a conflict, the specifically agreed B2B terms will govern the relevant transaction.


SECTION 4 — PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice.

The price charged for a product will normally be the price shown at checkout when the order is placed, subject to correction of errors as described in these Terms.

Unless expressly stated otherwise, displayed prices do not include applicable sales taxes, shipping charges, customs duties, brokerage fees or import charges.

Prices displayed online may differ from prices offered in physical locations, B2B portals, marketplaces or other sales channels.

Promotions may be subject to separate terms and conditions. If specific promotional terms conflict with these Terms, the promotional terms will govern that promotion.

You agree to provide accurate and complete billing, payment and account information.

You represent that you are authorized to use the payment method provided and that charges properly incurred in connection with your order will be honoured.

We reserve the right to correct pricing errors. If an obvious pricing error affects an order, we may contact you to offer the option of proceeding at the correct price or cancelling the affected item or order, subject to applicable law.


SECTION 5 — SHIPPING AND DELIVERY

Shipping and delivery dates are estimates unless we expressly state otherwise.

We are not responsible for delays caused by circumstances outside our reasonable control, including carrier delays, weather, customs processing, transportation disruptions, labour disruptions, incorrect addresses or other external events.

Customers are responsible for providing a complete and accurate delivery address.

If a shipment is returned because of an incorrect or incomplete address, refusal of delivery, failure to collect a shipment or another circumstance attributable to the recipient, additional shipping charges may apply.

For international orders, customers are responsible for any applicable duties, taxes, customs charges, brokerage charges or import fees unless we expressly indicate that such charges are included or prepaid.

Risk of loss and responsibility for shipments will be determined in accordance with applicable law and the shipping method used.

If a shipment appears lost or damaged, please contact us promptly so that we can assist with the carrier investigation where appropriate.


SECTION 6 — INTELLECTUAL PROPERTY

The Services and their contents, including trademarks, logos, text, graphics, photographs, videos, product information, software, layout and design, are owned by or licensed to Ping Pong Virtuoso, its affiliates, suppliers or licensors and are protected by Canadian and other applicable intellectual property laws.

These Terms permit you to use the Services for lawful personal or business purchasing purposes.

Unless expressly authorized, you may not reproduce, distribute, modify, republish, publicly display, commercially exploit or create derivative works from protected content belonging to Ping Pong Virtuoso or its licensors.

Nothing in these Terms grants you any ownership interest or licence in trademarks, copyrights or other intellectual property except as expressly stated.

Manufacturer names, logos and trademarks appearing on the Services remain the property of their respective owners.

Shopify's trademarks and other intellectual property remain the property of Shopify and its licensors.


SECTION 7 — OPTIONAL AND THIRD-PARTY TOOLS

We may provide access to tools, applications or services supplied by third parties.

We do not necessarily monitor or control these third-party services.

Such tools may be provided on an “as available” basis and may be governed by the third party's own terms and privacy policies.

Your use of third-party tools is at your discretion and may be subject to separate agreements between you and the applicable provider.

We may introduce additional tools, features or resources in the future. Unless otherwise stated, they will form part of the Services and will be subject to these Terms.


SECTION 8 — THIRD-PARTY LINKS

The Services may contain links to third-party websites, applications, services or resources.

We are not responsible for reviewing or guaranteeing the accuracy, security, availability or content of third-party websites or services.

If you access a third-party website or service, you do so subject to that provider's terms and policies.

Ping Pong Virtuoso is not responsible for losses or damages arising solely from your dealings with an independent third party.

Questions or complaints relating specifically to third-party products or services should generally be directed to the applicable provider.


SECTION 9 — RELATIONSHIP WITH SHOPIFY

Ping Pong Virtuoso is powered by Shopify, which provides technology that enables us to operate our online store and Services.

Purchases made from our store, however, are transactions directly between you and Ping Pong Virtuoso.

Shopify is not the seller of products purchased directly from Ping Pong Virtuoso and is not responsible for fulfilling those purchases.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, damages or losses arising solely from products or services sold to you by Ping Pong Virtuoso.


SECTION 10 — PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy [LINK] and applicable privacy legislation.

Because our online store is hosted using Shopify, Shopify may collect and process certain personal information relating to your access to and use of the Services.

Information necessary to provide our Services may also be shared with service providers such as payment processors, shipping carriers, fraud prevention providers, analytics services and other suppliers.

Certain service providers may process information outside Quebec or Canada.

SECTION 11 — REVIEWS, COMMENTS AND FEEDBACK

If you submit product reviews, suggestions, photographs, comments, ideas or other content to us (“Feedback”), you represent that you have the right to provide that content.

Unless otherwise prohibited by law, you grant Ping Pong Virtuoso a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, distribute and adapt Feedback for purposes including operating, improving and promoting our Services.

You remain responsible for the accuracy and legality of content you submit.

Feedback must not:

  • infringe another person's intellectual property or privacy rights;

  • contain unlawful, defamatory, abusive or obscene material;

  • contain malware or harmful code;

  • impersonate another person; or

  • intentionally misrepresent the origin or authenticity of a review.

We reserve the right, but not the obligation, to moderate or remove Feedback that violates these Terms or applicable law.


SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS

Information available through the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, specifications, pricing, promotions, inventory, shipping charges, transit times or availability.

We reserve the right to correct errors and update information at any time.

Where permitted by applicable law, we may cancel or modify an affected order if material information relating to that order was incorrect.

Nothing in this section limits any rights you may have under applicable consumer protection legislation.


SECTION 13 — PROHIBITED USES

You may use the Services only for lawful purposes.

You may not use the Services to:

  • violate any applicable federal, provincial, state, local or international law;

  • infringe intellectual property or other rights;

  • submit fraudulent, misleading or false information;

  • impersonate another individual or organization;

  • interfere with the security or operation of the Services;

  • introduce malware, viruses or harmful code;

  • collect personal information about others without lawful authority;

  • send spam or unauthorized promotional communications;

  • circumvent security, access restrictions or technological protections; or

  • use the Services in a way that materially interferes with other users or our operations.

You may not systematically scrape, extract, reproduce or commercially exploit our website, product database, pricing data, photographs or other content without our prior authorization, except where such restriction is prohibited by applicable law.

We reserve the right to restrict or terminate access to the Services where we reasonably believe these Terms have been violated.


SECTION 14 — AUTOMATED AGENTS

This section applies to automated or semi-automated software, services, bots or artificial intelligence systems that access or interact with the Services (“Agents”).

Agents must not attempt to conceal their automated nature, bypass security measures, circumvent CAPTCHAs, evade access restrictions or interfere with normal operation of the Services.

Where technically required by us, automated services must identify themselves appropriately when interacting with our systems.

We reserve the right to restrict or block automated access where necessary to protect our Services, customers, systems, product information or business operations.

Authorized integrations, search engines and services operating with our permission are not prohibited by this section when used in accordance with applicable requirements.


SECTION 15 — TERMINATION

We may suspend or terminate access to some or all of the Services where permitted by law, including where we reasonably believe that these Terms have been violated, fraud has occurred, or use of the Services creates a security or operational risk.

Termination does not eliminate amounts properly owing for orders or transactions completed before termination.

Provisions that by their nature should continue after termination—including intellectual property, limitation of liability, indemnification, governing law and privacy obligations—will survive termination.


SECTION 16 — DISCLAIMER OF WARRANTIES

Information provided through the Services is intended primarily for general product and shopping information.

Table tennis equipment selection involves individual preferences and playing characteristics. Product descriptions relating to speed, spin, control, hardness, feel, skill level or playing style are intended as guidance and may involve manufacturer descriptions or subjective assessments.

We do not guarantee that a particular blade, rubber, racket or other product will produce a specific playing result or be suitable for every individual player.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR WARRANTIES OR RIGHTS THAT CANNOT LEGALLY BE EXCLUDED, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WE DO NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE UNINTERRUPTED, SECURE OR ERROR-FREE.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS WARRANTIES, GUARANTEES OR OTHER RIGHTS THAT CANNOT BE EXCLUDED UNDER APPLICABLE CONSUMER PROTECTION LAW.

Manufacturer warranties may also apply to certain products.


SECTION 17 — LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PING PONG VIRTUOSO AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

THIS MAY INCLUDE, WHERE PERMITTED BY LAW, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA OR OTHER INDIRECT COMMERCIAL LOSS.

THE FOREGOING LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LEGALLY BE EXCLUDED OR LIMITED.

Nothing in these Terms is intended to waive or restrict mandatory rights available to consumers under applicable Quebec, Canadian or other applicable law.


SECTION 18 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Ping Pong Virtuoso and its affiliates, directors, officers, employees, agents, contractors and service providers against third-party claims, losses or reasonable legal expenses arising directly from:

  1. your material breach of these Terms;

  2. your unlawful use of the Services;

  3. your infringement of another person's rights; or

  4. content or information you submit in violation of these Terms.

This section does not apply to the extent that a claim results from the negligence, misconduct or legal responsibility of Ping Pong Virtuoso.


SECTION 19 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in full force and effect.


SECTION 20 — WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.

These Terms, together with our Privacy Policy, Return & Exchange Policy and any other policies or terms expressly incorporated by reference, constitute the agreement governing your use of the Services.

Separate written agreements applicable to wholesale, B2B, dealer or commercial accounts may supplement these Terms.

If a specifically negotiated written agreement conflicts with these Terms, the specifically negotiated agreement will govern the matters it addresses.


SECTION 21 — ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where applicable law provides otherwise.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, corporate restructuring, sale of business or similar transaction, subject to applicable law.


SECTION 22 — GOVERNING LAW

These Terms and any separate agreements under which we provide the Services are governed by the laws applicable in the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Subject to any mandatory consumer protection rights concerning jurisdiction, disputes relating to these Terms or the Services will be submitted to the courts having jurisdiction in Quebec.

Nothing in this section deprives a consumer of any mandatory right or protection available under applicable law.

Section headings are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.

The most current version of these Terms will be available on this page.

We may update or replace portions of these Terms from time to time.

Where required by applicable law, we will provide notice of material changes.

Unless otherwise required by law, changes will become effective when the updated Terms are posted or on the effective date identified in the applicable notice.
